Division of Marital Property in Kentucky Divorce
Know How the Court Distributes Marital Property During A Divorce
Kentucky state law considers properties acquired by either spouse after marriage and before legal separation to be marital property. Assets that fall into this category are up for division, regardless of whether the spouse owns the property individually or through joint ownership. The only exceptions are gifts and inheritances you acquired in your name alone.
As an equitable distribution state, properties are fairly divided between the spouses during divorce. While equitably doesn’t necessarily mean equal, the assets may be divided equally, depending on what the court thinks is fair.
The court considers these factors to distribute properties equitably:
- Each spouse’s contribution to how the marital property is acquired (this also includes their contribution as a homemaker)
- The value of the property set apart for each spouse
- The length of the marriage
- The economic circumstances of each spouse during the property division.
Debts and assets are divided by a property settlement agreement during a divorce in Kentucky. The agreement lets you and your spouse negotiate and divide the property independently.
However, the outcome of the division is still subject to the court’s scrutiny. If you and your partner can’t conclude how to divide the property, the court will help you decide.
